Brighton Gardens of Tuckerman Lane is North Bethesda assisted living facility that offers assisted living, long-term and short-term resident services.

Brighton Gardens is owned by Virginia-based Sunrise Senior Living which is an international nursing home that has over 250 assisted living facilities in the United States. There are 13 other Sunrise nursing home in Maryland, located in Anne Arundel County, Montgomery County, Baltimore County, and Frederick.

The Brighton Gardens facility is quite small, with only 41 beds. It seems like more often than not these smaller facilities, at least in Maryland, are better run. Brighton Gardens is not an exception.

This facility has a four out of five stars Medicare overall rating. They excel in most of the tested categories, especially the health inspections category which is the category that is the Achilles' heel for most nursing homes. They were only noted to have three deficiencies, compared to the state average of 10 and the U.S. average of 6.9.

There were a few troubling things in their last inspection. One patient failed to get a needed test and no one informed the doctor. In another case, a patient did not get her pain medication as needed. There was also a citation for failing to determine which staff was responsible for which patients. Not to minimize these serious concerns but is a glowing report compared to a lot of the nursing home we have brought lawsuits against (and reviewed on this website).

Interestingly, there was no data gathered about the staff hours per day that each resident receives. Nursing home lawyers know that underfunded staffs often equal injury and wrongful death lawsuits from residents. But the quality measures rating can provide some indication that the residents must be receiving enough attention because they are getting their recommended care.

A quick search did not reveal any lawsuits against Brighton Gardens. Sunrise Senior Living has had some jury verdicts against it. In 2008, a jury awarded plaintiff $2 million in his wrongful death claim against a Sunrise Senior Living facility, where the man’s estate alleged that he died of sepsis after eight weeks at the facility.

Another jury, also in 2008, awarded a woman’s estate $2 million in her nursing home negligence case, after her death in the nursing home. She argued that the home failed to prevent her falls and ulcers from developing.

The third case in 2008 resulted in a jury awarded a man’s estate $3 million in his nursing home negligent supervision case, where he alleged her suffered burns and ulcerations of his mouth/throat after swallowing lye. He subsequently developed aspiration pneumonia and died.

In 2007, Sunrise Senior Living was ordered to pay $279,000, after a man claimed that they breached their contract by misrepresenting the living conditions, resulting in fraud. This little fact will not make the company brochure.

Verdicts against assisted living facilities are rare. Why? These cases almost always settle before trial. So it is noteworthy that Sunrise Senior Living has been so willing to let lawsuits go to trial. You may be thinking, but these are only four cases. But it is rare when a large chain of nursing homes allows any abuse or neglect case to go to trial.
